Pro-Gota Lawyers cry foul

24 Oct 2019

A group of Pro Gota President's Counsels today questioned the motives of Ahimsa Wickrematunge who filed a motion against Gotabaya Rajapaksa in the U.S. court at the "eleventh hour". President's Counsels Kushan de Alwis, Mohan Weerakoon, Mayura Gunawansa and Razeek Zarook were speaking at a press conference held in Colombo today. "Ahimsa Wickrematunge had 10 years to file a case since the assassination of her father in January 2009, but the case was filed at the eleventh hour, in the run up to the presidential election this year," Weerakoon claimed. Weerakoon said Ahimsa had four and half years to file a case since 2015 when the yahapala government came into power. "Gotabaya Rajapaksa is not the Defense Secretary of this country anymore," he noted. He added that the current government has not arrested anyone with regard to the investigations on Lasantha's assignation. "Many cases have been brought up in the past few months in an attempt to harm Gotabaya Rajapaksa's candidature." The group of President's Counsels said damages would be claimed against those who have misrepresented the case verdict to the public in a recent press conference. He said the former Defense Secretary  has "rigorously disputed the allegations of the plaintiff in a motion file against the 'First Amended Complaint' at the California District Court. The group while pledging their support to Rajapaksa, urged that the election be fought clean without any misrepresentation or mud slinging. On 15 July Ahimsa Wickrematunge filed a case against Rajapaksa alleging him  of the extrajudicial killing of her father late Editor-in-Chief of the Sunday Leader newspaper ,Lasantha Wickrematunge, crimes against humanity and torture. Subsequently, defendant Rajapaksa had sought court, through a motion, to dismiss the case as he was immune from suit under the doctrine of common law foreign official immunity and as such lacks jurisdiction over this action. In her application to court she has stated that the reason for her to file the lawsuit against Rajapaksa in the US Court was because all her efforts to seek justice in Sri Lanka had failed as the then Defence Secretary and his allies obstructed the cases by tampering with witnesses and engaging in a pattern of coercion and intimidation. The United States District Court, however, dismissed the case on grounds that the defendant is entitled to common law foreign official immunity.
