Deputy Solicitor General (DSG) Madhawa Tennakoon informed the Supreme Court (SC)
yesterday (14) that he would represent only the Attorney General (AG) who has been named as the 12th respondent in the fundamental rights (FR) petition filed in connection with an incident of pouring a liquid mixed with chillie on the genitalia of a suspect arrested by the Teldeniya Police.
He informed the matter to the SC when the FR petition filed by the victim, Ruwan Shantha Priyadarshana was taken up before the SC Judges, Justices, President's Counsel Yasantha Kodagoda, and Kumudini Wickremasinghe.
In the petition, Priyadarshana has stated that it was confirmed during an investigation carried out by the Human Rights Commission of Sri Lanka that the Teldeniya Police had arrested him (Priyadarshana) on 27 January 2023, and tortured him by detaining him illegally.
In addition to the AG, the Acting Inspector General of Police, the Teldeniya Headquarters Inspector of Police and several others have been named as respondents to the petition.
When the petition was taken up yesterday, DSG Tennakoon informed the SC that the incident in question is a serious matter of concern. The SC accordingly ordered the petitioner that notices be referred to the respondents including the Acting IGP.
Attorneys Manushika Cooray, Madhawa Iriyagama, and Suren D. Perera appeared for the petitioner Priyadarshana. The petition is to be taken up again on 19 December.
