SC grants amendment to ex-CID Chief’s FR petition

The Supreme Court (SC) has granted permission for an amended petition in the Fundamental Rights (FR) case brought forth by Shani Abeysekera, the former Director of the Criminal Investigation Department (CID). 


In a hearing before the three-member SC bench comprising Justices Vijith Malalgoda, Kumuduni Wickramasinghe, and Mahinda Samayawardena, President's Counsel Salia Peiris, representing petitioner Shani Abeysekera, sought permission to file an amended petition. 


The bench, presiding over the case, has set the next hearing for 30 April, instructing Abeysekera's legal team to submit the amended petition before that date.


Abeysekera alleges that, following President Gotabaya Rajapaksa's election in 2019, he was unjustly transferred from his position as the Director of the CID to the Assistant of the Deputy Inspector General of Galle without valid cause. 


The core argument in Shani Abeysekera's FR petition revolves around the violation of his basic human rights due to these actions. 


The amended petition is expected to provide additional details and legal grounds to strengthen Abeysekera's case against the IGP's decision.
