Citizen beaten to death in front of police officers: SC to proceed with FR case over Susil Indrajith’s death

By Ruwani Fonseka The Supreme Court (SC) yesterday (11) heard the submissions that had been made on behalf of all the petitioners and the Attorney General pertaining to the death of Susil Indrajith, and has thereafter decided to grant leave to proceed on the alleged infringement of the fundamental rights (FR) guaranteed by articles 11, 12(1), and 13(4) of the Constitution. Susil Indrajith, aged 47 years and a father of two children, was found dead in the Weligama area on 17 May 2021. Local CCTV footage showed the motionless body of Indrajith on the road as a bus ran over him. Just before that, a person had assaulted Indrajith whilst two police officers watched the incident without intervening and stopping the assault. Indrajith had arrived at the Weligama town to pick up some food for his family as they had run out of all dry rations and essential goods at home and had no food. Sources told The Morning that the Supreme Court had also directed the Inspector General of Police (IGP) and the Officer-in-Charge (OIC) to produce certified copies of all relevant Magistrate’s Court proceedings and CCTV footage. Accordingly, the case will be argued on 27 June after the respondents file their objections. Furthermore, the state counsel had said that they are taking steps to prosecute the private party and also disciplinary action against the police officers.
